These terms apply when you use the Capital Garage mobile application and the capital-garage.com website. By creating an account or using the app you agree to them. If you do not agree, please do not use the service.
Capital Garage is operated by Alex Hoyle, a sole trader registered in the United Kingdom. In these terms, "we", "us" and "our" mean that operator, and "you" means the person using the service.
01What Capital Garage is
Capital Garage is a portfolio tracking tool for classic and performance cars. It records the vehicles you tell it you own and estimates their current market value by drawing on publicly available auction results and classified listings.
Capital Garage is not regulated financial advice. Valuations are estimates produced by an automated model from third party data. They are not appraisals, not offers to buy or sell, and not a guarantee of what any vehicle will achieve at sale. Cars are not a regulated investment product. You should not make a purchase, sale, insurance or financing decision on the basis of a figure shown in the app without seeking your own professional advice.
02Accounts
You need an account to use Capital Garage. You may create one with an email address and password, or by signing in with Apple or Google depending on your device.
- You must be at least 18 years old to create an account.
- You are responsible for keeping your credentials secure and for activity that happens under your account.
- You must give accurate information when you register.
- One person, one account. Do not share your login.
You can delete your account at any time from within the app, under your profile. Deleting your account removes your garage, your saved vehicles and your profile data. You can also request deletion by emailing support@capital-garage.com.
03Free and premium
Capital Garage has a free tier and a paid premium tier.
The free tier lets you track one vehicle with its valuation, and read market news. Premium adds unlimited vehicles, price history charts, the comparable sales behind each valuation, auction data covering live, upcoming and past lots, market insights, and portfolio analytics across your whole garage.
04Subscriptions, billing and cancellation
Premium is offered as a monthly or annual auto renewing subscription. Current prices are shown in the app before you buy, in your local currency, and take precedence over any price quoted elsewhere.
Subscriptions are sold and processed by the app store you downloaded the app from, not by us directly. We never see or store your payment card details.
- On iOS, billing is handled by Apple through your Apple Account. Manage or cancel your subscription in your Apple Account settings.
- On Android, billing is handled by Google through Google Play. Manage or cancel your subscription in your Google Play subscriptions settings.
Where a free trial is offered, it converts into a paid subscription automatically at the end of the trial period unless you cancel at least 24 hours before the trial ends. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends.
Cancelling stops future renewals. It does not refund the current period, and your premium access continues until the end of the period you have already paid for.
Refunds are handled by the store that processed the payment, under that store's own policy. We cannot issue refunds for store purchases directly. If you believe something has gone wrong, contact us and we will help where we can.
If you subscribe on one platform and later sign in on another using the same Capital Garage account, your premium access carries across. Buying a second subscription on the other platform is not necessary.
We may change subscription prices. If we do, existing subscribers will be told in advance through the app or by email, and the change will only apply from the start of the next billing period.
05Your content
The vehicle details, photographs, purchase prices and notes you enter remain yours. You give us permission to store and process that information solely in order to run the service for you, including producing your valuations and portfolio figures.
We do not sell your data, and we do not publish your garage or make it visible to other users.
06Valuation data and accuracy
Valuations are generated from publicly available auction results and classified listings gathered from third party sources. That data can be incomplete, delayed or wrong, and vehicles vary enormously in condition, specification, history and provenance in ways an automated model cannot fully capture.
We take reasonable care over the model, but we do not warrant that any valuation, market figure, chart or auction listing shown in the app is accurate, current or complete. Where a valuation is based on a small number of comparable sales, the app indicates lower confidence, and those figures should be treated with particular caution.
07Acceptable use
You agree not to:
- Scrape, harvest, copy or redistribute the valuation data, market data or auction data in the app.
- Reverse engineer, decompile or attempt to extract the source code of the app.
- Use automated systems to access the service, or interfere with its normal operation.
- Use the service for anything unlawful, or upload content you do not have the right to upload.
- Resell, sublicense or commercially exploit access to the service.
08Intellectual property
The Capital Garage name, logo, app, website, design, valuation model and underlying data compilation are ours and are protected by intellectual property law. Using the service gives you a personal, limited, non transferable and revocable licence to use the app for its intended purpose. It does not transfer any ownership to you.
Vehicle manufacturer names and model names are the trade marks of their respective owners and are used only to identify vehicles. Capital Garage is not affiliated with, endorsed by or connected to any vehicle manufacturer, auction house or listings platform.
09Availability and changes
We aim to keep the service running, but we do not guarantee it will be uninterrupted or error free. We may change, suspend or discontinue features, and we may carry out maintenance that makes the service temporarily unavailable.
If we discontinue the service entirely, we will give reasonable notice and refund any unused portion of a prepaid subscription period where we are able to.
10Suspension and termination
We may suspend or close an account that breaches these terms, that is being used unlawfully, or that is being used in a way that damages the service or other users. Where it is reasonable to do so, we will tell you first.
You may stop using the service and delete your account at any time.
11Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, we are not liable for any loss arising from a decision you make on the basis of information in the app, including any loss on the purchase, sale, insurance or financing of a vehicle. We are not liable for indirect or consequential loss, or for loss of profit, revenue or data.
Where liability can be limited, our total liability to you in any twelve month period is limited to the amount you paid us for the service in that period.
If you are a consumer, you have statutory rights under UK consumer law that these terms do not affect.
12Privacy
How we handle your personal data is set out in our Privacy Policy, which forms part of these terms.
13Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. If a change is material we will tell you in the app or by email before it takes effect. Continuing to use the service after a change means you accept the updated terms.
14Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in your own jurisdiction.
